MBA | Make Your Voice Heard on Paid Sick Leave Proposal in the Michigan Legislature

The Michigan Supreme Court recently ruled that a 2018 ballot proposal will take effect on Feb. 21, enacting a one-size-fits-all paid leave benefits for full-time, part-time and seasonal employees.

The Michigan House and Senate are currently in their "lame duck" session, and we need your help! Businesses across the state face tremendous uncertainty with the paid leave requirements resulting from the Court ruling, and we need the Michigan Legislature to act.

The Earned Sick Time Act (ESTA) imposes some of the most far-reaching and stringent paid time off provisions found in any state – and we need the Legislature to pass legislation to soften the impact.  Here’s why:

• Even if your bank offers 72 hours or more of leave to employees today, ESTA will require you to change your benefits.

• There are no exemptions – even for small businesses – and all employees must be covered: full-time, part-time, seasonal, temps, and maybe even independent contractors.

• The 72 hours of mandatory leave can be used intermittently without advanced notice to the employer, which will exacerbate talent issues in the marketplace.

• Currently, the proposal would require all unused sick leave at the end of a year to roll over to the next year, with no cap on the number of hours that can be rolled over.

• It’s a litigation nightmare, allowing employees to sue businesses for any adverse personnel action taken regardless of potential abuses by the employee.

With the Court’s decision set to take effect in February, we are on a tight deadline to achieve legislative changes. Lawmakers need to hear from their constituents like you on this issue. Please ask them to support House Bill 6057!
